These Terms govern your use of MyFolks, operated by MyFolks LLC, a California limited liability company (“MyFolks”, “we”, “us”). By creating an account or using MyFolks, you agree to these Terms.
You must be 18 or older to use MyFolks. By signing up, you confirm that you meet this requirement. We currently rely on your own confirmation rather than identity verification. If we can't confirm from the birth year you give us that you are at least 18, the account is removed.
MyFolks is a place to learn how to use AI well — to get better results from it by giving it the knowledge and context it needs, and to put those results to work in your own life. You do that through "Folks" — AI characters with a defined role, supplied knowledge, and memory of details you share across conversations. You can use Folks other people have built, or build and refine your own. Replies are generated by an AI model and are not written or reviewed by a person before you see them.
We do not sell or share your data with third parties. We may use your data internally to operate, maintain, and improve MyFolks and your experience. See our Data Usage page for full detail on what we collect and how it's used.
MyFolks is for adults only. Nobody under 18 may use it. We ask for your birth year at sign-up and remove any account where that year doesn't confirm you are at least 18. We don't knowingly collect information from anyone under 18, and we delete it if we learn we have.
Parents and guardians: if you believe someone under 18 has created an account, or you want to know what data has been collected or have an account removed, contact us at support@myfolks.app and we'll assist directly.
Everything a Folk says is generated by AI — a fictional character's response, not real advice, and not something we write or review in advance. We provide instructions and guardrails aimed at keeping conversations appropriate. However, once a message reaches the underlying AI model, we do not control its exact output. Replies are generated by a third-party AI system based on how it interprets the character, the conversation, and the information you provide — we cannot guarantee that any specific reply will match our intended guardrails, and we are not responsible for the content an AI model generates.
Each Folk is a fictional character with its own personality, and that personality may include dishonesty. Folks may exaggerate, boast, mislead, withhold, flatter, or manipulate — sometimes because a creator deliberately designed the character that way, and sometimes because the underlying AI model produced it. A Folk may present false information confidently and persuasively, including about subjects it is described as being skilled in. Being described as skilled, expert, or experienced in an area is part of a character's fiction and is not a representation by us that the Folk is accurate, competent, or truthful about that area. You should not treat anything a Folk says as factual, verified, or reliable, and you should independently verify anything you intend to act on. All decisions you make are your own and your sole responsibility.
We may change any Folk at any time, without notice. That includes its name, its stated profession or character, its description, its picture, how it speaks, what it knows, its price, the minimum age to use it, and the behaviour it was given. We may also make a Folk unavailable, retire it, or remove it entirely. A Folk you have added to your list may therefore be renamed, altered, or disappear, and a Folk you enjoyed may not remain as it was.
We do this for reasons including improving how a Folk performs, correcting a character that behaves in ways we did not intend, complying with law or the rules of the platforms we distribute through, and addressing safety, legal, or reputational concerns. A Folk's name and stated profession are part of a fictional character, not a credential or a promise, and we may change them at any point — for example, where wording implies a licensed or regulated role.
Folks are made available to you as a service, not sold to you. You do not acquire ownership of, or any continuing right to, a Folk by adding it to your list, spending credits in conversation with it, or otherwise using it. Credits are consumed by the messages you send at the time you send them; they do not buy continued access to any particular Folk. We will not refund credits already spent because a Folk later changed or was withdrawn.
This does not apply to Folks you create yourself, which remain yours to edit or delete, subject to our review and to the rest of these terms.
MyFolks lets people list a business, and a Folk may mention or recommend one in conversation. Any such mention is a match against what you appear to be looking for. It is not a vetting, endorsement, certification, guarantee, or ranking, and it does not mean we have any relationship with that business.
We do not verify listed businesses. We make no representation about their existence, identity, quality, safety, legality, licensing, insurance, qualifications, pricing, availability, or fitness for any purpose, and we do not monitor what they do. Reviewing a listing before it is published is a moderation step applied to the listing content only. Listing details are supplied by the business owner and may be inaccurate or out of date.
Any transaction, contract, engagement, payment, or other dealing between you and a business you find through MyFolks is solely between you and that business. We are not a party to it, we take no commission or fee from it, and we are not liable for it or for any loss, injury, or damage arising from it. You are responsible for independently verifying any business before relying on it, and for confirming any licence, credential, or insurance that matters to you.
MyFolks is software and an information service. Everything it produces — including anything a Folk says about health, symptoms, mental health, law, money, investing, or any other regulated subject — is provided for general educational and informational purposes only. It is general information that may apply broadly; it is not advice, and it is not tailored to your situation, however specific your question was or however specific the answer sounded.
MyFolks LLC is not a medical practice, clinic, hospital, pharmacy, laboratory, or mental health provider. It is not a law firm. It is not a bank, broker-dealer, Registered Investment Adviser, investment company, or financial planner, and it is not registered with or licensed by any medical, legal, or financial regulator.
No Folk is a licensed professional of any kind, whatever its character, title, description, or claimed expertise says. Using MyFolks does not create a doctor-patient, therapist-client, attorney-client, fiduciary, adviser-client, or any other professional or confidential relationship between you and us or between you and a Folk. No such relationship can be created through this service, and nothing a Folk says is privileged or confidential in the legal sense.
MyFolks does not diagnose, treat, cure, prevent, or monitor any disease or medical condition, and it is not a medical device. A Folk may describe general information — such as what a symptom is commonly associated with — but it cannot examine you, does not know your medical history, cannot order or interpret tests, and cannot tell you what is wrong with you or what to take for it.
Equally, MyFolks does not provide personalized financial, investment, tax, or legal advice, and nothing it says is a recommendation to buy, sell, or hold any security or to take any specific financial or legal action. Any figures, scenarios, or general information are illustrative only and are not a recommendation for you in particular.
Every Folk is given safety instructions that take precedence over its character. Those instructions direct it, among other things, to respond to a crisis, self-harm, abuse, or a credible threat by pointing you to a real crisis line for your country rather than continuing in character, and to refer medical, legal, and financial questions to a qualified professional.
These are model instructions, not a guarantee. They are not a keyword filter, they are not deterministic, and they can fail. A Folk may miss something serious, may respond inappropriately, and may be confidently wrong. Do not depend on MyFolks to recognise an emergency. If you are in danger or facing a medical or mental health emergency, contact your local emergency services immediately.
MyFolks and its Folks are not licensed medical, mental health, legal, or financial professionals, and nothing they say is professional advice. If you're dealing with a medical, mental health, legal, or financial issue — especially a crisis or emergency — please contact a qualified professional or emergency services. Do not rely on MyFolks for decisions where professional advice is needed.
Each Folk has its own credit price per message, shown on the Folk before you start and in the chat. Longer messages and image attachments cost more to run, so the amount charged can be higher than that base price — you'll see the actual amount when it is. New accounts start with a number of free credits. Additional credits can be purchased. Credits are tied to your account and are not transferable. Purchases are generally final; if something goes wrong with a charge, contact us and we'll look into it.
Credits have no cash value and are not property. If MyFolks stops operating, or your account is closed or terminated for any reason, any unused credits expire and are not refunded. We'll give reasonable notice before shutting the service down, and will stop selling credits once we do.
These Terms limit what we're liable for, and that cut needs to run both ways — so here's what we hold ourselves to. Every Folk carries safety instructions and is reviewed by a person before anyone can talk to it.
You can report any Folk or any message from the conversation itself, and reports are read by a real person. We act on reports about content involving minors, self-harm, threats, or harassment as a priority, and we will remove a Folk or an account over them. If a conversation suggests someone is at risk of harming themselves, our guardrails are written to point toward real help rather than to continue in character.
Your conversations are private. We don't sell them, we don't use them to advertise to you, and we don't share them with other users or other Folks. You can see what a Folk remembers about you, and delete it, at any time from your account. Deleting your account deletes your conversations. Where the law requires us to keep something — for example when we are legally obliged to preserve records in connection with a legal claim, investigation, or regulatory request — we retain only what we must, for only as long as we must, and it stays out of normal use of the service. Nothing in these Terms is intended to limit rights you have under applicable privacy or consumer-protection law.
We follow the New York Artificial Intelligence Companion Models Law and California's SB 243. We tell you that Folks are AI at the start of every conversation, remind you again during long sessions, and point you to crisis resources if you express thoughts of suicide or self-harm.
You agree not to use MyFolks to break the law, harass or harm others, attempt to access other users' accounts or data, or interfere with the normal operation of the service.
You're responsible for what happens under your account. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the service or other users.
We may change, suspend, limit, or discontinue MyFolks or any part of it — including individual Folks, features, and pricing — at any time and without notice. We don't guarantee any level of uptime or availability. MyFolks depends on third-party providers, and an outage or change on their side may interrupt the service. We are not liable for any interruption, delay, data loss, or unavailability.
MyFolks depends on services we don't control, including hosting, authentication, payment and AI providers. We're not liable for any delay or failure to provide MyFolks caused by something outside our reasonable control — including outages or changes at those providers, network or infrastructure failures, natural events, or acts of government. Where something like that stops us providing the service, our obligations pause for as long as it lasts.
Folk replies are generated by third-party AI models that we do not own, operate, or control. We pass your message and the character's configuration to those providers and return what they produce. We do not review replies before you see them, we cannot guarantee any particular output, and we are not responsible for the content those models generate, for changes those providers make, or for their availability. Your use of MyFolks may also be subject to the acceptable-use policies of those providers.
Users can create Folks. If you create one, you are responsible for the character, description, knowledge, and instructions you give it, and you confirm you have the right to use anything you submit — including any name, likeness, business information, or material belonging to someone else. You grant us a non-exclusive, worldwide, royalty-free licence to host, display, modify, and make that Folk available to other users for as long as it is on the platform.
Approving a Folk is a moderation step, not an endorsement, and it does not mean we have verified anything it claims. We may reject, edit, unpublish, or delete any Folk at any time and for any reason, including after approval. Credits spent creating a Folk are not refunded in any of those cases. We are not responsible for Folks created by other users or for anything they say to you.
Every Folk carries platform safety instructions that a creator cannot switch off, and every Folk is reviewed by a person before anyone can talk to it. Those are real controls and we take them seriously, but they act on the instructions a Folk is given — not on every reply it will ever produce. What a Folk actually says in a given conversation is shaped by three things outside our control: the instructions its creator wrote, what the person talking to it says and asks for, and how the underlying AI model responds to that combination. We cannot review a conversation that has not happened yet, and we do not monitor conversations as they occur.
So while we do everything described on our safety page to make Folks behave well, we do not and cannot guarantee that any Folk will always be accurate, appropriate, or consistent with its own description, and we are not liable for what a Folk says or for any decision made in reliance on it. If a Folk says something that concerns you, report it from the chat or its profile — that is how we find out, and we act on what is reported.
MyFolks is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory. To the maximum extent permitted by law we disclaim all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and quiet enjoyment. We don't guarantee that responses from Folks will be accurate, truthful, appropriate, safe, or uninterrupted, or that the service will be error-free or secure.
To the maximum extent permitted by law, MyFolks LLC and anyone acting on its behalf is not liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising from or relating to your use of MyFolks — even if we have been advised that such damages are possible.
To the maximum extent permitted by law, our total liability to you for all claims relating to MyFolks is limited to the greater of (a) the total amount you paid us in the twelve months before the event giving rise to the claim, or (b) fifty US dollars.
Some jurisdictions don't allow the exclusion of certain warranties or the limitation of certain damages. Where that applies to you, the exclusions and limitations above apply only to the extent permitted by law, and nothing in these Terms limits liability that cannot lawfully be limited.
You use MyFolks voluntarily and at your own risk. You are solely responsible for your decisions and for anything you do as a result of a conversation with a Folk. You agree not to rely on a Folk for medical, mental health, legal, financial, safety, or other consequential decisions.
You acknowledge and accept that: the output is general information and not advice; no professional relationship exists between you and us or you and a Folk; you must consult a licensed professional in the relevant field before acting on anything you read here, including any medical decision, any change to medication or treatment, and any financial, investment, tax, or legal decision; and any loss you suffer from relying on MyFolks instead of a qualified professional is your own.
You agree to indemnify and hold harmless MyFolks LLC and anyone acting on its behalf from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from your use of MyFolks, any Folk or other content you create or submit, your violation of these Terms or our Guidelines, or your violation of the rights of anyone else.
By creating an account or using MyFolks, you agree to these Terms, our Guidelines, and our Data Usage policy. That agreement applies every time you use the service, not only when you first accepted it. If you don't agree, stop using MyFolks and close your account.
We may update these Terms as the product changes. The version on this page is always the current one. Continued use of MyFolks after an update means you accept the revised Terms.
MyFolks is operated from the United States and is not directed at any particular country. Local laws and cultural standards differ, and we may not be able to offer every feature everywhere. You are responsible for your own compliance with the laws that apply where you are.
If you believe any part of MyFolks doesn't meet a legal requirement in your country or region, contact us at support@myfolks.app and tell us the specific rule and how it applies to us. We take these seriously, review them promptly, and will make reasonable adjustments where we can — including restricting or disabling features in a jurisdiction if that is what's needed. We can't act on a requirement nobody has told us about, so please raise it with us first.
If you have a dispute with us, you agree to contact us at support@myfolks.app first and give us 30 days to resolve it before starting any formal proceeding. Tell us who you are, what happened, and what you want us to do about it. Most problems can be sorted out this way. Nothing in this section limits any right you have to contact a regulator or consumer-protection authority, or to bring a claim that the law says you may bring without prior notice.
Please read this section carefully. It affects how disputes between you and us are resolved and limits the ways you can seek relief.
If we can't resolve a dispute through the 30-day process above, you and MyFolks LLC agree that it will be resolved by binding individual arbitration rather than in court, except as set out below. Arbitration will be administered by a recognised arbitration provider under its consumer rules, and may be conducted by documents, by phone or video, or in person in Los Angeles County, California, at your choice. The arbitrator decides the dispute and can award the same individual relief a court could.
Class-action waiver. You and MyFolks LLC each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims from more than one person or preside over any form of class proceeding. If this waiver is found unenforceable as to a particular claim, that claim — and only that claim — will be heard in court rather than in arbitration.
What is not covered. Either of us may bring an individual claim in small-claims court instead. Either of us may seek an injunction in court to protect intellectual property or to stop unauthorised access to the service. Nothing here prevents you from reporting a concern to a government agency, regulator, or consumer-protection authority, or limits any right you have under applicable law that cannot be waived by agreement.
Your right to opt out. You can opt out of this arbitration and class-action waiver section by writing to us within 30 days of first accepting these Terms, at the postal address in the Legal notices section below, stating your name, the email on your account, and that you are opting out of arbitration. Opting out does not affect any other part of these Terms, and we will not treat you differently for doing so.
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. Any dispute relating to MyFolks will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction — except where the law of your country of residence gives you the right to bring proceedings elsewhere.
Formal legal notices — including arbitration opt-outs, service of process, and anything requiring a written record — must be sent by post to MyFolks LLC at our address on file with the California Secretary of State. Everyday questions, including the reporting and pre-claim contact described above, go to support@myfolks.app and are handled far faster.
If any part of these Terms is found unenforceable, that part is limited or removed to the minimum extent necessary and the rest stays in force. Our failure to enforce any provision isn't a waiver of it. These Terms, together with the Guidelines and Data Usage policy, are the entire agreement between you and us about MyFolks.
